Statute of Limitations

The four-year statute of limitations provided for under Uniform Commercial Code has been held to apply to the Song-Beverly Consumer Warranty Act, rather than general four-year statute covering actions arising from a written agreement. See Krieger v. Nick Alexander Imports, Inc. (App. 2 Dist. 1991) 285 Cal.Rptr. 717, 234 Cal.App.3d 205. In the Krieger case, the four-year statute of limitations for breach of warranty of an automobile began to accrue, under both the Song-Beverly Consumer Warranty Act and for an express warranty, on the date the breach was discovered, rather than date automobile was purchased.
